The Government hasn't allocated up to this time an adequate space to carry out accordingly, even though Mrs. Georgeta Basarabescu - President of the National Supervisory Authority for Personal Data Processing - has carried out the legal steps required in order to solve the issue referring to the premises as the lease contract expires on the 19^th January 2011.

We would like to present below the content of the information submitted to the Prime-Minister, the General Secretariat of the Government, the Parliament and Presidency:

„In view of the provisions of article 114 of Convention implementing the Schengen Agreement, the National Supervisory Authority for Personal Data Processing, together with the Ministry of Administration and Interior, is directly involved in the process of Romania's adhesion to the Schengen area.

Apart from the recommendations of the Schengen evaluation mission referring to granting adequate premises for the national supervisory Authority, I would like to inform you that on the 19^th January 2011, the lease contract for the current premises located in str. Olari nr. 32, 2^nd district, Bucharest, expires.

We would like to mention that solving the issue of the premises exceeds the legal competence of the national supervisory Authority and the Government hasn't granted adequate premises to carry out the activity of personal data protection.

In this way a major risk is created as regards Romania's adhesion to the Schengen area and the good functioning of the national supervisory Authority. We will also not be able to inform the European bodies, including the European Council and Commission, of a correspondence address of our institution.
