On the 16th of November 2018, the Extraordinary Plenary of European Data Protection Board, body with legal personality, established based on Article 68 of the General Data Protection Board, took place.

One of the topics referred to the Opinion of the European Data Protection Board on the Commission proposal for a Decision on the adequate level of protection in Japan, in light of the provisions of Article 45 of the General Data Protection Regulation.

During this Plenary, in light of provisions of Article 70 e) of General Data Protection Regulation, in order to ensure an harmonized approach of the Member States when assessing the balance between the right to the protection of personal data and the right to freedom of expression, ANSPDCP has brought to the attention of the European Board the proposal to five mandate to one of the Board’s subgroup to prepare a position paper of EDPB on the balance provided by Article 85 of the Regulation.
